US Digital Asset Bills Tracker

The US Congress has introduced dozens of digital asset bills. This tracker monitors every significant piece of legislation from introduction to enactment.

The United States has moved from regulatory paralysis to legislative productivity on digital assets in the space of one congressional session. This tracker monitors the status of every significant federal digital asset bill — from enacted law to committee consideration to floor scheduling. For each bill, we track sponsors, the committee of jurisdiction, vote counts where applicable, and current status.

Enacted Legislation

GENIUS Act (Guiding and Establishing National Innovation for US Stablecoins Act)

  • Status: Enacted. Signed July 18, 2025.
  • Senate vote: 68-30 (bipartisan).
  • Sponsors: Senator Bill Hagerty (R-TN) and Senator Kirsten Gillibrand (D-NY) as primary bipartisan sponsors.
  • Provisions: Federal licensing framework for payment stablecoin issuers. Eligible issuers: insured depository institutions, federally chartered non-bank issuers, and their subsidiaries. Reserve requirements: 1:1 backing with US dollar, Treasury bills, Federal Reserve deposits. Annual audit obligations. Consumer protection provisions.
  • Investment significance: Validated Circle’s USDC compliance model; created federal path for bank stablecoin issuance; complicated Tether’s US market positioning.

Passed House — Senate Pending

CLARITY Act (Digital Asset Market Structure and Investor Protection Act)

  • Status: Passed House 294-134, July 2025. Senate: committee referral to Banking Committee and Agriculture Committee (joint jurisdiction). Floor timeline: uncertain.
  • House sponsors: Representative Glenn Thompson (R-PA) and Representative French Hill (R-AR) as primary House Financial Services Committee leads. Representative GT Thompson (R-PA) as Agriculture Committee lead.
  • Provisions: Framework for distinguishing “digital commodities” (CFTC jurisdiction) from “digital securities” (SEC jurisdiction). Registration regime for digital commodity exchanges. Disclosure requirements for digital asset issuers. Safe harbour provisions for certain token distributions.
  • Investment significance: Would resolve the most significant remaining US crypto regulatory uncertainty — whether major crypto assets are securities or commodities, and which agency regulates their spot trading.

Active Committee Consideration

Digital Asset Anti-Money Laundering Act (various iterations)

  • Status: Multiple versions introduced across congressional sessions. Current iteration in committee. Sponsors have varied across sessions; Senator Elizabeth Warren (D-MA) has been the primary driver of AML-focused provisions.
  • Provisions: Extended Bank Secrecy Act obligations to unhosted wallets; crypto ATM reporting requirements; enhanced FinCEN oversight of DeFi.
  • Investment significance: If enacted in strict form, would significantly increase compliance costs for exchanges and wallet providers. Crypto industry has lobbied against stringent versions.

State Bills — Selected Significant Actions

Wyoming

  • Special Purpose Depository Institution (SPDI) law: Enacted. Created a state-chartered bank charter for crypto-native companies. Custodia Bank’s SPDI application was the subject of prolonged Federal Reserve dispute before Atkins-era regulatory environment improved.
  • Wyoming DAO LLC law: Enacted. First US jurisdiction to provide legal structure for decentralised autonomous organisations.

Texas

  • Senate Bill 21 (Strategic Bitcoin Reserve): Passed both chambers, signed by Governor. Texas established a state-level strategic Bitcoin reserve — among the first US states to do so.

New York

  • New York Department of Financial Services (NYDFS) BitLicense: Not a bill — administrative framework. Most burdensome US state-level crypto licensing regime. NYDFS has issued approximately 30 BitLicenses and issued multiple enforcement actions.

Key Committee Structures

Senate Banking Committee has primary jurisdiction over banking and financial regulation, covering stablecoin and bank digital asset provisions. Senate Agriculture Committee has concurrent jurisdiction over CFTC matters, including digital commodity trading. This joint jurisdiction creates coordination challenges that have complicated Senate floor scheduling for market structure legislation.

House Financial Services Committee produced CLARITY Act. House Agriculture Committee co-produced CLARITY Act for CFTC-jurisdiction provisions. The House’s bipartisan process produced the 294-134 margin.
